1. Accounts
- You must be at least 16 years old to use Elsa.
- Give us accurate information and keep it up to date.
- Keep your sign-in details and your devices secure. You are responsible for activity on your account. Tell us at once at support@twinciti.com if you think your account has been used without permission.
2. What Elsa does
Elsa operates your browser and desktop apps for you: it clicks, types, reads your screen and, if you connect them, uses your Google services. It sends screen content to our servers and AI model providers to decide what to do, as described in the Privacy Policy.
3. Your responsibilities
- You are responsible for what Elsa does on your behalf. Actions Elsa takes on your accounts, on websites and in apps are your actions. Only teach or run workflows you are allowed to perform yourself.
- You are responsible for following the terms of every website, app and service Elsa uses for you, including any rules about automated access.
- You must have the right to use any content, accounts and data you give Elsa access to.
- Teaching records your microphone. If other people can be heard, you must tell them and get any consent the law where you are requires.
4. Acceptable use
You must not use Elsa to:
- break any law or anyone else's rights;
- access accounts, systems or data you are not authorized to access;
- send spam, commit fraud, or harass or harm anyone;
- spread malware or interfere with any service or network;
- probe, attack, reverse engineer or overload Elsa or our servers, or get around any limit we set;
- resell or provide Elsa to others without our written permission.
5. AI output can be wrong: supervise Elsa
Elsa uses AI, and AI makes mistakes. Elsa can misread a screen, click the wrong thing, enter the wrong data or report a result incorrectly. Websites and apps also change. Review what Elsa does, especially before it sends messages, makes payments, deletes anything or takes any other action that is hard to undo. Do not rely on Elsa where a mistake could cause serious harm.
6. Your content and outputs
You keep ownership of your workflows, recordings and other content you give Elsa. You give us permission to use them only to provide and support Elsa for you, as described in the Privacy Policy.
As between you and us, you own the outputs Elsa produces for you, such as data it collects or text it writes. We assign to you any rights we have in those outputs. Outputs may not be unique, and other users may receive similar outputs.
7. Subscriptions and payments
- Current plans, prices and what tasks cost are shown in the Elsa app. Payments are processed by Stripe.
- A subscription renews automatically at the end of each billing period, at the price then in effect, until you cancel. By subscribing, you authorize us, through Stripe, to charge your payment method for each renewal.
- You can cancel at any time from Manage Subscription in the Elsa app. Cancellation takes effect at the end of the current billing period; your plan stays active until then.
- Refunds are covered by our Refund Policy.
- We may change prices or how credits work. We will tell you before a change affects a paid subscription.
- Prices may not include taxes, which you are responsible for.
- If you think a charge is wrong, contact us before disputing it with your bank. If you dispute a charge, we may suspend your account and remove the credits bought with that payment.
8. Credits
- What credits are. Elsa uses credits. Tasks use credits as they run. You get credits with a subscription or by buying them.
- Automatic top-ups. If you turn on automatic top-ups, we charge your payment method for the top-up amount you chose when your balance falls below the threshold you set, until you turn them off. Refunds of top-up charges are covered by our Refund Policy.
- Expiry. Credits that come with a subscription expire at the end of the billing period they were granted for. Credits you buy, including automatic top-ups, expire 180 days after purchase.
- Cash value. Credits have no cash value and cannot be exchanged for money.
- Transfer. Credits belong to your account and cannot be transferred, sold or shared with another account.
- When you cancel. Your subscription credits stay usable until the end of the billing period you paid for. Credits you bought stay usable until they expire.
- When your account ends. If your account is closed, any unused credits are lost and are not refunded.
9. Beta features
We may offer features marked as beta, preview or experimental. They are provided as is, may not work as expected, and may change or be removed at any time.
10. Our service and intellectual property
Elsa, its software and its content belong to us and our licensors. We give you a personal, non-exclusive, non-transferable right to use Elsa under these terms. We may change, add or remove features, and Elsa may sometimes be unavailable.
11. Third-party services
Elsa works with websites, apps and services we do not control, such as Google. Your use of them is governed by their own terms, and we are not responsible for them.
12. Export controls and sanctions
You may not use, export or provide access to Elsa in any country or region under embargo, or for anyone on a government restricted-party list. You confirm that you are not in such a place and not on such a list.
13. Termination
You can stop using Elsa at any time and delete your account from the Account page in the Elsa app, or by emailing support@twinciti.com. We may suspend or end your access if you break these terms, if your use creates risk or legal exposure for us or others, or if we discontinue a service. If we suspend or end your access because you broke these terms, we may remove all your credits, with no refund. Sections that by their nature should survive termination will survive.
14. Disclaimers
ELSA IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT ALLOWED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ELSA WILL BE ACCURATE, UNINTERRUPTED OR ERROR-FREE, OR THAT ANY TASK WILL BE COMPLETED CORRECTLY.
15. Limitation of liability
TO THE FULLEST EXTENT ALLOWED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL OR BUSINESS, ARISING FROM YOUR USE OF ELSA OR ACTIONS ELSA TOOK FOR YOU. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO ELSA IS LIMITED TO US$100, REGARDLESS OF THE AMOUNT YOU PAID FOR ELSA CREDITS. Some places do not allow these limits, so they may not fully apply to you.
16. Indemnity
You will defend and compensate us for claims and losses arising from your content, your workflows, actions Elsa took at your direction, or your breach of these terms or of any third party's terms.
17. Governing law and disputes
These terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules. Disputes will be resolved in the courts of the state and federal courts located in Delaware, United States, unless the law where you live gives you the right to bring them elsewhere.
18. Changes to these terms
We may update these terms. We will post the new version here with a new effective date and tell you in the app or by email before material changes take effect. If you keep using Elsa after that, you accept the new terms.
